What to Bring to Your First Appointment as an Executor
First Executor Appointment:
What to Bring in NSW
What to Bring to Your First Appointment as an Executor?
If you’ve recently been named as the executor of a will in NSW, your first appointment with us is an important step. It’s your opportunity to understand your legal responsibilities, ask questions, and start the probate and estate administration process with clarity.
You may be feeling unsure about what to bring or how to prepare — and that’s completely normal. At Gibson Howlin Lawyers, we meet many first-time executors who have never been through this process before. That’s why we’ve created this simple, practical guide to help you feel ready and confident before your initial meeting.
Why This Appointment Matters?
As the executor, you have a legal duty to administer the deceased person’s estate properly and in line with their will. Your first appointment helps establish:
Whether probate is required
What your duties will involve
How the estate should be managed
Whether you need any immediate legal steps (such as securing assets or handling debts)
Coming prepared will ensure that we can give you tailored advice right from the start.
What to Bring to Your Executor Appointment?
Here’s a checklist of documents and information that will be most useful during your first meeting:
The Original Will (If Available) The original, signed will is the most important document. If you only have a copy, bring that — we can help locate the original, if we don’t already have it in our safe custody.
Death Certificate We will need the original death certificate. If you do not have it with you for the first appointment, you can provide it to us when you receive it.
Contact Details for all Executors and Beneficiaries A list of the names, addresses, and phone numbers of the people named in the will is helpful for estate correspondence and planning.
Details of the Deceased’s Assets and Liabilities Bring any statements, documents or notes relating to the deceased person’s assets and liabilities, such as:– Bank accounts – Superannuation funds – Property (titles or rates notices) – Shares or investments – Insurance policies – Outstanding debts, loans, or credit cards
Even if you don’t have everything, provide us with as much as you can — we can guide you on how to gather what’s missing.
Funeral Invoice (If Paid or Unpaid) The estate is usually responsible for covering funeral expenses. Providing the invoice helps us guide you on arranging payments and reimbursements.
Personal Identification We will need to verify the identity of all executors – bring your driver licence, passport, or other government-issued photo ID.
Optional but Helpful Items?
While not essential, these additional documents can speed up the process:
Title searches and mortgage details for property
Vehicle registration details
Tax File Number (TFN) and recent tax returns
Centrelink or DVA details
Passwords or access information for digital accounts
What Will Happen During the Appointment?
During your first executor consultation, we will:
Review the will and explain its legal meaning
Outline your role and responsibilities
Help you plan the next steps
Answer any questions you have
You’ll leave the appointment with a clearer understanding of what lies ahead — and a support team you can count on throughout the estate administration process.
Tips for Executors: Preparing Mentally and Emotionally
Acting as an executor can sometimes bring emotional or family tension. Take a few moments before your appointment to:
Write down any questions or concerns
Make notes of anything unusual or unclear in the will
Prepare emotionally to discuss the deceased’s personal affairs
Remember, you are not expected to have all the answers — we are here to support and guide you.
